Is drone liability insurance mandatory?

Civil Aviation Authority recommends every operator to have the insurance!

Currently, third party liability insurance for UAV operators with drones weighing less than 20 kg is voluntary. The requirements for insurance of drones weighing above 20 kg are specified in Regulation (EC) No. 785/2004 of 21 April 2004 on insurance requirements for air carriers and aircraft operators.

Open category - involves performing VLOS operations (no permit required) with drones weighing less than 25 kg and flights up to a maximum height of 120 m above terrain (or over an obstacle higher than 120 m). In this category, the risk to third parties is close to zero.

The Special Category involves conducting VLOS/BVLOS operations, which require a declaration of compliance with standard scenarios or authorization from the appropriate authority. In this category, the risk to third parties is greater compared to operations in the Open Category.

Recreational variant - civil liability of an unmanned aircraft pilot who operates an unmanned aircraft due to personal interests, for rest, entertainment, free of charge and outside professional duties, in his/her free time.

Professional variant - civil liability of an unmanned aircraft pilot performing unmanned aircraft operations in:

a. for commercial purposes or in connection with work (the scope of professional insurance does not cover high-risk flights listed in the General Terms and Conditions of Insurance), or

b. during participation in competitions, organized events, or shows, regardless of whether participation in these events is associated with the generation of income.
